These Terms & Conditions (“Terms”) govern your use of the SxxFit application (the “App”), operated by Shenzhen Yunyuan Technology Co., Ltd (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not copy, modify, reverse-engineer, resell, or distribute the App or its content.
3. Acceptable Use & Your Content
You are solely responsible for the photos and content you upload (“User Content”). By using the App, you agree that you will NOT:
- Upload photos of any person under 18 years of age;
- Upload photos of other people without their explicit consent;
- Create, generate, or share content that is sexually explicit, pornographic, non-consensual, defamatory, harassing, hateful, or otherwise unlawful;
- Use the App to impersonate, harm, intimidate, or violate the privacy or rights of any person;
- Upload content that infringes any copyright, trademark, or other intellectual property right;
- Use the App for any illegal purpose or in violation of any applicable law.
Zero-tolerance policy: Any attempt to produce sexual, exploitative, or non-consensual imagery is strictly prohibited and may result in immediate termination of access and reporting to the appropriate authorities.
4. Ownership of Content
You retain ownership of the photos you upload. You grant us a limited license to process those photos solely to provide the App’s features (e.g., generating try-on results). We do not claim ownership of your User Content and do not use it to identify you. AI-generated outputs are provided to you for your personal use.
5. AI-Generated Results
The App uses artificial intelligence to generate virtual outfit previews. Results are simulations and may not accurately represent real garments, fit, color, or appearance. Outputs are provided “as is” for entertainment and fashion-exploration purposes and should not be relied upon as an exact representation.
6. Intellectual Property
All rights, title, and interest in the App — including its design, logos, software, and content (excluding your User Content) — belong to us or our licensors and are protected by applicable laws.
7. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation. We do not guarantee that results will meet your expectations.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your User Content, your use of the App, or your violation of these Terms or any law or third-party right.
10. Termination
We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms. Upon termination, the license granted to you ends immediately.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the People’s Republic of China.
